Consumer Terms of Service

For individuals subscribing for personal use (not for business purposes). Governing law: England and Wales.

These Consumer Terms apply if you are an individual using any Mile End Media subscription product for your own personal, non-business use. Nothing in these Terms affects your legal rights as a consumer, which always apply and which we cannot ask you to give up.

These Consumer Terms of Service ("Terms") are an agreement between you and Mile End Media Limited, registered in United Kingdom under number 17030248, registered office 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ ("we", "us", "our"). By ticking "I agree", creating an account, or paying, you accept these Terms.

1. About the Service

Mile End Media Limited provides subscription software. "the Service" means whichever of our subscription products you have subscribed to, together with any associated websites, apps, documentation and support we make available for it. Where you subscribe to more than one, these Terms apply to each of them separately.

We give you a personal, non-transferable right to use the Service for your own use while your subscription is active.

Where we tell you that a product is in its Early Access Period, that product is still in an early stage of development — see Section 3 and the Early Adopter & Beta Programme Addendum, which applies to it and forms part of these Terms for as long as that period lasts.

2. Your consumer rights come first

Because you are a consumer, you have legal rights that these Terms do not change. In the UK, under the Consumer Rights Act 2015 digital content and services must be of satisfactory quality, fit for purpose and as described, and must be supplied with reasonable care and skill. If they are not, you may be entitled to a repair, a price reduction or a refund. Similar protections apply under the consumer laws of the EU and other countries. Nothing in these Terms limits or excludes any right or remedy you have under law that cannot lawfully be limited or excluded.

3. Early stage / early adopter products

This Section applies to any product we have told you is in its Early Access Period. We are honest that such a product is new and still being developed. This means you may occasionally experience bugs, changes, or periods when it is unavailable. We tell you this clearly before you subscribe so you can decide with your eyes open, and it is why early adopters pay a reduced price. This does not remove your consumer rights above; it simply describes what "satisfactory quality" reasonably means for a clearly-labelled early-access product at a reduced price. Please keep your own copies of anything important to you.

4. Price, payment and automatic renewal

  • The price is shown clearly before you pay and is charged in advance for each period (for example each month). Your subscription then renews automatically at the same price for the same period until you cancel.
  • We will make your renewal date and price clear at sign-up, and you can see and cancel your subscription at any time from your account. You can cancel a renewal any time before it happens; cancellation takes effect at the end of the period you have already paid for.
  • If we ever change the price, we will tell you in advance and it will only apply from a future renewal, so you can cancel first if you prefer.
  • Prices include VAT where applicable. Payments are handled securely by our payment provider.

5. Your 14-day right to cancel a new subscription

As a consumer you normally have 14 days to change your mind about an online purchase and get a refund. Because the Service is digital and starts straight away, when you subscribe you will be asked to agree that we can start providing it immediately. If you agree and then cancel within the 14 days, you may be charged a proportionate amount for the part you have used. If you would rather keep the full 14-day cancellation right unused, you can tell us not to start the Service until the 14 days have passed. This right to change your mind is in addition to your right to cancel the ongoing subscription at any time.

6. Using the Service responsibly

Please use the Service lawfully and don't misuse it — for example by trying to break, disrupt or gain unauthorised access to it, using it to break the law or infringe someone else's rights, or sharing your account so others can avoid paying. Keep your login details safe. We may suspend or close an account that is being misused, giving you notice where we reasonably can.

7. Our responsibility to you

We take real care to provide a secure, working Service and we are responsible to you for loss we cause where the law says we are. We do not exclude or limit our liability to you in any way where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, and for breach of the consumer rights described in Section 2.

We are not responsible for loss that was not foreseeable, for loss arising from your own breach of these Terms, or for business losses (the Service is provided for personal use only; if you use it for business, our Business Terms and their limits apply instead).

8. Ending your subscription

You can cancel at any time from your account; you'll keep access until the end of the period you've paid for. We may end or suspend your access if you seriously break these Terms, if we're required to by law, or if we stop offering the Service (in which case we'll give reasonable notice and refund any period you've paid for but won't receive). You can export anything you want to keep before your access ends.

9. Changes to these Terms or the Service

We may update the Service and, occasionally, these Terms. If we make a change that materially affects you, we'll tell you in advance and, where the law requires, ask you to agree. If you don't want to accept a change, you can cancel before it takes effect.

10. Complaints and dispute resolution

If something's wrong, please contact us first at support@mileendmedia.co.uk — we aim to put things right quickly. These Terms are governed by the law of England and Wales, and you can bring a claim in the courts of England and Wales; if you live elsewhere in the UK or the EU, you may also have the right to bring proceedings in your local courts, and you keep the benefit of any mandatory consumer protections of the country you live in.

11. General

If any part of these Terms is found to be unfair or unenforceable, the rest still applies. We may transfer these Terms to someone who takes over our business, as long as it doesn't affect your rights. You can't transfer your account to someone else without our agreement.
